DISCflex Terms and Conditions

1. Academic Studies and Testimonials
   By using the DISCflex eLearning Platform, you may grant DISCflex the right to use your name in academic studies or publications related to behavioral analytics. You may also grant DISCflex permission to use any testimonials you provide on DISCflex-owned websites or in marketing materials. DISCflex will contact you directly if either of these situations applies.
2. Access and Timing
   Time is of the essence in this agreement. Upon receipt of initial payment, online access to the DISCflex platform will be granted within two (2) business days.
3. Marketing Communications
   By using the DISCflex platform, you grant DISCflex the right to use your name and email for both direct and indirect marketing communications. Additionally, DISCflex may share this information with its certified partners and affiliates for related marketing purposes.
4. Effective Date of Agreement
   This agreement becomes effective once payment or any identifying customer information is received and processed by DISCflex.
5. Governing Law, Venue, Waiver of Jury Trial, and Attorney Fees
   This agreement shall be governed by the laws of the State of Florida. Both parties waive the right to a jury trial in any dispute related to this agreement. In the event of legal action, the prevailing party is entitled to recover reasonable attorney fees and costs.
6. Entire Agreement & Amendments
   This document constitutes the full and complete agreement between DISCflex and the customer. No previous or present representations made by DISCflex or its agents that are not included here shall be binding. Amendments must be made in writing and signed by both parties to be valid.
7. Severability
   If any provision of this agreement is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

Logging into any DISCflex products or registering for a DISCflex account via www.discflex.com constitutes acceptance of this agreement and these terms and conditions.
